Anti-Spam Policy

You must follow this Acceptable Use / Anti-Spam Policy.

In short, do not spam anyone. If you do, we will immediately close your engageSPARK account. You will not get any refund.

Words used in this Policy that begin with a capital letter have the definitions given to them in our Terms of Service.



You are prohibited from using engageSPARK to send any Messages that are offensive, promote anything illegal, or harass anyone. You may not send:

  • Pornography or other sexually explicit Messages
  • Messages offering to sell illegal goods or services
  • Messages that violate any laws that are applicable to you, including messages that violate any Anti-SPAM laws that are applicable to you
  • Marketing or commercial Messages without permission

Some industries have higher-than-normal abuse complaints, which can in turn jeopardize the deliverability of our entire system. To maintain the highest delivery rates possible for all our Members, we cannot allow businesses that offer these types of services, products, or content to use the Service:

  • Tobacco-related marketing messages
  • Escort and dating services
  • Pharmaceutical products
  • Work from home, make money online, and lead generation opportunities
  • Online trading, day trading tips, or stock market-related content
  • Gambling services or products
  • Multi-level marketing
  • Affiliate marketing
  • Credit repair and get out of debt opportunities
  • Nutritional, herbal, and vitamin supplements
  • Adult novelty items or references
  • List brokers or list rental services
  • Activities relating to political campaigns, political candidates, election campaigning, and/or similar activities



You may not:

  1. Send Spam. By “spam,” we mean unwanted Messages.
  2. Put into your Messages any Content that wasnt created by you, provided for you to use, or that would violate anyone’s rights.
  3. Use any misleading or incorrect names, addresses, email addresses, subject lines, or other information on the Website or in any Messages created or sent using the Service.
  4. Share your password.
  5. Decipher, decompile, disassemble, or reverse engineer any of the software on our Website, or in any way used or downloaded from the Website.
  6. Use any of the software on our Website, or downloaded from the Website, to create a competing product.
  7. Import or incorporate any of this Content into any lists, Messages or uploads to our servers: Social Security numbers, passwords, security credentials, or sensitive personal information of any kind.
  8. Send transactional Messages through engageSPARK.
  9. Use an outside unsubscribe process.
  10. Submit purchased lists, rented lists, or third-party lists to the Website.
  11. Send Messages to recipients whose contact details you obtained from purchased lists, rented lists, or third-party lists
  12. Send Content created in engageSPARK through another service.



You may only use engageSPARK to send Messages to people and entities that either:Gave you permission to send Messages to them, have not withdrawn that permission, and either:

1. Gave you permission to send Messages to them, have not withdrawn that permission, and either

  1. gave you that permission in the past 12 months; or
  2. did not object to promotional content you sent them in the past 12 months.

2. Gave you their name and contact details in connection with a purchase, or negotiations to purchase, a product or service from you, have not opted out from receiving your emails, and either

  1. purchased something from you or negotiated a purchase from you in the past 12 months; or
  2. did not object to promotional content you sent them in the past 12 months.

If you send Messages to a list and you get an unusual amount of SPAM complaints or opt-out requests, we may suspend your account or close your account for cause. So if you do not have proof that every recipient on your list opted-in to receive your Messages, or otherwise meets the requirements listed above, then do not submit the recipient’s contact details to the Service.



Here are some steps you can take to avoid accidentally becoming a spammer or otherwise wreaking havoc on our system:

      1. Sending your first engagement to an old list of contacts? Some recipients will not remember you, and they will report you for spamming. Remind them who you are and how they got on your list in the first place.
      2. Importing from a CRM? Break your list into separate groups so you can send relevant Messages to your recipients (e.g., “Women ages 20-30 in Nairobi”; “People who bought a certain product from us in the past”). Do not just mix a bunch of different lists together and send one “blast” Message to all of them.
      3. If you are sending on behalf of clients, educate them about responsibly sending Messages. They are depending on you to be the expert.
      4. Before importing a list into engageSPARK from your CRM or another database, read and understand our permission rules. Remove any prospects or leads that didn’t explicitly request Messages from you or otherwise meet the requirements in our Terms. Even if you are sending Messages to individuals or entities that consented to receive your Messages, you still may be required by law to allow them to opt out of receiving your Messages (you may need to turn on that feature in your CRM tool).
